"Suspect new laptop is NOT new"

Bought suposed new Toshiba laptop in September,difficuilty in commissioning but sorted with shop's help and 5 visits.Now deletes photos (unasked)unable to log into fsmail emails even though passwords correct,unable to install security disc.Machine has several programs loaded and dated July (i.e.2 months before purchasing)suggests laptop had already been rejected by someone else and therefore new.Staple response"sounds like software problems ,not hardware,therefore nothing to with us.Citizen's advice disagree and say not fit for purpose under sale of goods act.Haven't got the time or patience to take to court so best not to deal with these people again..
